{"id":271,"date":"2008-05-28T14:26:24","date_gmt":"2008-05-28T14:26:24","guid":{"rendered":""},"modified":"2016-08-09T18:17:02","modified_gmt":"2016-08-09T18:17:02","slug":"iam-union-s-sham-elections-kim-jong-il-would-be-proud","status":"publish","type":"post","link":"https:\/\/nrtw.org\/es\/blog\/iam-union-s-sham-elections-kim-jong-il-would-be-proud\/","title":{"rendered":"IAM Union&#8217;s Sham Elections: Kim Jong-il Would Be Proud"},"content":{"rendered":"<p>\nThe <a href=\"http:\/\/www.goiam.org\/\">International Association of Machinists<\/a> (IAM) has a long and <a href=\"\/blog\/floridian-triggers-elimination-nationwide-iam-union-policy\">troubled<\/a> <a href=\"\/special-bulletin-union-bosses-forced-pay-175-000-two-fired-workers\">relationship<\/a> with true workplace representation.\u00a0 In fact, the union bosses&#8217;\u00a0authoritarian nature\u00a0of governance\u00a0more closely resembles\u00a0communist North Korea.\n<\/p>\n<p>\nSection B-2 of the IAM&#8217;s <a href=\"\/files\/nrtw\/IAM%20Contract%20Ratification%20and%20Strike%20Circular.pdf\">&quot;Official Circular No. 813 &#8211; Strike Sanctions and Benefits&quot;<\/a> (pdf) lays out the organization&#8217;s procedures for accepting a renegotiated contract or rejecting a new offer from management and going on strike:\n<\/p>\n<blockquote>\n<p>\n\t&quot;. . . a secret ballot vote by the membership present and voting must carry by a two-thirds (2\/3) majority in order to declare a strike.&quot;\n\t<\/p>\n<\/blockquote>\n<p>\nSection B-3 makes it perfectly clear that IAM officials can unilaterally &quot;ratify&quot; a collective bargaining agreement <i>even if a majority of employees vote against the new contract<\/i>. In other words, IAM representatives are empowered <i>by<\/i> <i>their own regulations<\/i> to ignore workers&#8217; preferences:\n<\/p>\n<blockquote>\n<p>\n\t&quot;In the event that a strike vote fails to carry by the required two-thirds (2\/3) majority vote, <b>the collective bargaining agreement at issue will be accepted<\/b>.&quot; [Emphasis in original]\n\t<\/p>\n<\/blockquote>\n<p>\nNot exactly what you&#8217;d call fair &#8212; vote no, but get yes. A recent NLRB administrative law judge <a href=\"\/files\/nrtw\/New%20Process%20Steel%20and%20District%20Lodge%2034,%20IAM%20-%20NLRB%20Ruling.pdf\">ruling<\/a> (pdf) involving a collective bargaining dispute in Indiana reveals that local IAM officials agreed to a renegotiated contract despite the fact that <i>a majority of employees had already rejected management&#8217;s new offer<\/i>:\n<\/p>\n<blockquote><p>\n\t&quot;The union put the agreement [the new contract] to a vote of employees and, following its established procedures, when less than a majority voted in favor of the contract, this triggered a strike vote requiring supermajority approval, and failing to garner approval for the strike, the contract was deemed accepted.&quot;\n<\/p><\/blockquote>\n<p>\nThis situation lays bare the fraud of exclusive representation, also known as monopoly bargaining.\u00a0 Unfortunately, workers\u00a0have little voice when\u00a0the union hierarchy\u00a0is installed as the middleman&#8230; and often given other compulsory unionism privileges to boot.\n<\/p>\n<p>\nWith help from Foundation staff attorneys, several employees have come forward to challenge the IAM&#8217;s monopoly bargaining privilege in\u00a0the above-referenced workplace. These workers are interested in having a real workplace voice, not meaningless sham elections that can be ignored on a whim.
