Their Foundation staff attorneys argue that the \u201copt-out\u201d schemes perpetrated by IAM and ALPA bosses violate workers\u2019 rights under the Railway Labor Act (RLA) and the First Amendment under the standard laid out in the landmark 2018 Supreme Court decision <em>Janus v. AFSCME<\/em>. <\/p>\n<p>\u201cNo employee or private citizen should be trapped in a deliberately-complex system that funnels their money into political speech of which they disapprove. Unfortunately, that is exactly what IAM and ALPA union officials are doing to non-member workers across America,\u201d commented National Right to Work Foundation Vice President and Legal Director Ray LaJeunesse. <\/p>\n<p><strong><center>Union Bosses Trap Workers in Complicated and Unconstitutional Scheme <\/center><\/strong><\/p>\n<p>The lawsuits contend that under <em>Janus<\/em> and the 2012 <em>Knox v. SEIU<\/em> Supreme Court case \u2013 both of which were argued and won by Foundation staff attorneys \u2013 no union dues or fees can be charged for union political activities without a worker\u2019s affirmative consent. <\/p>\n<p>Popp and Baisley, despite working in the Right to Work states of Florida and Texas, must still pay fees to their respective unions as the RLA preempts state law and permits forced dues. But, even in the absence of Right to Work protections, established Supreme Court precedent forbids unions from putting those compulsory fees towards ideological activities like lobbying or politics.<\/p>\n<p><strong><center>Suit: Under <em>Janus<\/em> and RLA, Workers Must Opt-In to Political Spending <\/center><\/strong><\/p>\n<p>According to the lawsuits, the processes that IAM and ALPA union bosses require independent-minded workers to go through simply to exercise their constitutional right not to fund \u201cnonchargable\u201d activities are convoluted and typically involve having to \u201cdecipher\u201d the opt-out requirements of the union.<\/p>\n<p>Even worse, after Baisley submitted a letter to IAM agents in November 2018 objecting to funding all union political activities, the union officials only accepted his objection for 2019, and told Baisley he would be required to renew his objection to full dues and fees the next year or else be charged for full union dues.<\/p>\n<p>The two complaints challenge these union boss-created policies on the grounds that they \u201crequire employees to opt-out of paying union fees that they have no legal obligation to pay\u201d and thus violate workers\u2019 First Amendment rights.<\/p>\n<p>The complaints also allege that the \u201copt-out\u201d requirements violate the RLA, which governs labor in the air and rail industries and \u201cprotects the right of employees to \u2018join, organize, or assist in organizing\u2019 a union of their choice as well as the right to refrain from any of those activities.\u201d<\/p>\n<p>Both suits are class-action, and seek court orders requiring union officials to ask for affirmative employee consent for any dues charged for political or ideological purposes in the future.<\/p>\n<p>\u201cThese lawsuits show that although <em>Janus<\/em>\u2019 most direct impact was to secure the First Amendment rights of public employees not to be required to fund Big Labor, the implications don\u2019t stop there,\u201d observed LaJeunesse. \u201cBecause the <em>Janus<\/em> decision made clear workers must opt-in to all political and ideological activity, Foundation staff attorneys are able to cite it in defense of airline workers covered by the Railway Labor Act.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p class=\"qtranxs-available-languages-message qtranxs-available-languages-message-es\">Disculpa, pero esta entrada est\u00e1 disponible s\u00f3lo en <a href=\"https:\/\/nrtw.org\/en\/wp-json\/wp\/v2\/posts\/11707\" class=\"qtranxs-available-language-link qtranxs-available-language-link-en\" title=\"English\">English<\/a>.<\/p>\n","protected":false},"author":16,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_lmt_disableupdate":"","_lmt_disable":"","footnotes":""},"categories":[895],"tags":[998,999,993,992,142,69,586,997,906,995,996,469,905,991,222,2784,994],"class_list":["post-11707","post","type-post","status-publish","format-standard","hentry","category-newsletter-articles","tag-air-line-pilots-association","tag-alpa","tag-arthur-baisley","tag-christian-popp","tag-foundation_action","tag-iam","tag-iam_union","tag-international-association-of-machinists","tag-janus-v-afscme","tag-jetblue","tag-knox-v-seiu","tag-railway_labor_act","tag-ray-lajeunesse","tag-rla","tag-supreme_court","tag-u-s-_supreme_court","tag-united-airlines"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.5 -
