Various retailers, package delivery companies, restaurants, and other employers hire additional temporary workers to meet the increased demands of service during the Holiday Season. Understanding that many of these temporary workers may be unaware of the rules and laws regarding forced union fees and membership, union officials often take advantage and deceive unsuspecting individuals into joining or paying union dues to a union with which workers may not necessarily want to associate nor are legally obligated to join.
To help these temporary workers understand their full legal rights, the National Right to Work Legal Defense Foundation has issued this annual Holiday Season legal notice to help protect against the injustices of forced unionism.
INFORMATION FOR HOLIDAY SEASON TEMPORARY WORKERS:
If you are a temporary worker in any state regardless of whether it has Right to Work protections, you do not necessarily have to join a union or pay union fees as a condition of employment for your temporary job. Union officials and some employers may wrongly tell you it is necessary for you to join a union or pay union fees, but there are some stipulations.
Time Limits: Seasonal workers should understand first and foremost that if you are working for LESS THAN 30 DAYS on the job, then you are not legally obligated to pay union fees or join a union.
Forced Union Fees: Some union officials, and even some employers, may pressure you into signing a card authorizing dues deductions, sometimes called “check off.” You legally DO NOT have to sign such a card. The dues check-off card would legally allow union officials to deduct money from your pay, in some cases your whole paycheck, in order to fulfill their dues demands.
Forced Union Membership: Some union officials, and even some employers, may pressure you to sign documents that would enroll you in a union with which you may not want to associate. You legally DO NOT have to sign these documents as a condition of employment. Forced union membership could trap you into paying union dues and fees well after you have ended your seasonal employment.

Remember these three important points before you sign any piece of paper concerning a union:

Unless you voluntarily want to join a union, DO NOT sign any card or other document stating you want to join a union, which could trap you in union membership even after your seasonal job has ended.

Unless you voluntarily want to pay union dues, DO NOT sign any card or other document authorizing dues deduction or check off that would allow union officials to take money automatically from your hard-earned paycheck.
