Houston Nurses File Decert Petition to Eject Unwanted Union

Regular Freedom@Work readers may remember the Foundation's ongoing efforts to help Houston nurses fight back against a coercive organizing scheme hatched by Tenet Healthcare Corporation and the California Nurses Association union bosses. We're pleased to report that the Foundation's charges have forced union officials to stop their illegal and coercive organizing efforts at two area hospitals. Not only that, but independent nurses have filed a union decertification petition at a third location. From the Foundation's press release:

With free legal assistance from the National Right to Work Foundation, nurses at the Cypress Fairbanks Medical Center have filed a decertification petition with the National Labor Relations Board (NLRB) to remove an unwanted union from their workplace.

The nurses’ decertification petition comes on the heels of the California Nurses Association (CNA) union’s decision to withdraw its controversial petitions for unionization at the Park Plaza and Houston Northwest medical centers. Hospital employees became increasingly disillusioned with union officials after many nurses raised concerns about conflict in the workplace and the quality of patient care.

Hospital Employee Challenges Employer's Backroom Deal with Union Operatives

Regular Freedom@Work readers may remember the Foundation's ongoing efforts helping nurses fight back against the California Nurses Association (CNA) union's coercive organizing drives at Houston and Philadelphia-area healthcare facilities.

Now an employee at Hahnemann University Hospital in Philadelphia has again stepped forward, filing unfair labor practice charges against Tenet Healthcare Corporation for giving CNA operatives preferential access to company property for the purposes of union organizing. Previous Foundation unfair labor practice charges also allege union organizers are engaging in illegal prerecognition bargaining: in exchange for company assistance, union officials may have agreed to terms and conditions of employment on behalf of workers they don't even have the power to represent yet.

Bickering Union Bosses Quit Feuding to Ramp Up Coercive Organizing

After a long and vicious feud, it seems CNA and SEIU bosses have finally buried the hatchet... in the backs of independent nurses:

Two of the nation’s fastest-growing labor unions — the Service Employees International Union and the California Nurses Association — ended a bitter yearlong dispute on Wednesday by agreeing to work together to unionize hospital workers and push for universal health coverage.

For the last year, the two unions have viciously denounced each other, with the service employees accusing the nurses of sabotaging efforts to organize 8,300 hospital workers in Ohio, and the nurses’ union accusing S.E.I.U. officials of stalking and harassing its leaders.

“We have buried the hatchet,” said Rose Ann DeMoro, president of the California Nurses Association/National Nurses Organizing Committee.

So the SEIU and CNA bosses have tabled their ugly little internecine war to focus on what's REALLY important to them -- corralling more nurses into forced-dues-paying ranks!

Given the circumstances, we're not too suprised by this touching reconciliation. The heart of the CNA-SEIU feud -- CNA criticisms of coercive SEIU organizing tactics -- was pretty much a dead letter after CNA operatives were implicated in the exact same practices at Houston and Philadelphia-area hospitals. EXPOSED: Naked CNA Union Boss Hypocrisy

Union boss hypocrisy is nothing new, but this recent case, filed by two nurses in Houston, Texas against the CNA union and Tenet Healthcare shows just how blatant that hypocrisy can be.

When the SEIU bosses got themselves a sweetheart deal to organize nurses from the top down with Catholic Healthcare Partners in Ohio, CNA/NNOC denounced the deal as an illegitimate sell out of workers’ rights to a free and fair election, and workers’ rights to choose or reject unionization with full information, and without coercion or discrimination:

Rose Ann DeMoro, executive director of the nurses association, condemned this [SEIU] agreement. She called it “a rigged scam” in which the service employees union would bargain only half-heartedly if it won the vote.

“This was a top-down deal between an employer and a hand-picked union,” Ms. DeMoro said. “There was a gag order on everyone, and as a result this was a banana republic election.”

CNA/NNOC even went so far as to create anti-SEIU websites accusing that union of selling out workers while cutting secret sweetheart deals with management, in exchange for assistance organizing new workers from the top down.

This is the game that union bosses play nowadays: they increasingly fail in organizing workers the old fashioned way, since workers increasingly aren't buying what the union bosses are selling. So, the union bosses try to organize companies, not workers, in what is known as “top down” organizing.

But all of this moaning and whining about SEIU’s secret “neutrality” deals has not stopped the CNA/NNOC brass from cutting their own secret sweetheart deals with companies. CNA/NNOC’s latest deal is a secret “neutrality” agreement with Tenet Healthcare, a nationwide hospital chain.

Under the agreement, Tenet is gagged from saying anything about the union, nurses' personal information is handed to the union without their consent, and union agents get wide access to campaign inside the hospital facilities while anti-CNA nurses are barred from effectively providing an opposing view in their own workplaces. Perhaps worst of all, the NLRB is cut out from overseeing the process, which results in Potemkin Village “consent elections” in which the NLRB does nothing other than tally up “yes” votes and “no” votes and provide a veneer of legitimacy.

Sounds like a sweetheart deal to us: nurses handed over to the union with no real campaign about the effects of unionization, and no effective federal agency to oversee the process!

In fact, CNA chief DeMoro's description of a "rigged scam," a "top-down deal between an employer and a hand-picked union," and a "banana republic election" is a strikingly apt description of DeMoro's own CNA union's secret deal with Tenet.

Video: Inter-Union Scuffle Erupts, Elderly Woman Knocked to the Ground

News today of more squabbling between SEIU and CNA union officials. A dispute over reigning roughly 8,000 Ohio nurses, and their forced union dues, into compulsory unionism led to a fight at a banquet.

As you can watch described below, not only did union operatives throw punches, hit people with signs, and link arms to block out the arriving police, but an elderly woman was also knocked to the ground.
